Claude Max 20x lawsuit: a judge lets the usage claims go ahead

On November 6, 2026, a federal judge in California let the Claude Max 20x lawsuit move forward. The case is about Anthropic's ads for its Max plans, which promised "5x or 20x more usage than Pro". The judge wrote that "the advertising in question is plausibly misleading". Anthropic hasn't lost anything yet: the case goes on, and nothing has been decided on the facts.

The headlines leave out two things. The numbers in the case are the plaintiffs' own, and since October 30 the $200 plan has a different name and a different promise.

What the judge ruled

The case is Kahn v. Anthropic PBC, combined with Smith v. Anthropic, in the US District Court for the Northern District of California. U.S. Magistrate Judge Alex G. Tse ruled on Anthropic's motion to dismiss.

Two claims go ahead: negligent misrepresentation and breach of contract, plus one plaintiff's claim under California's consumer protection law. Other claims were dismissed, including those under California's false advertising and unfair competition laws.

Claude subscriptions are billed monthly, so a buyer could reasonably read "20x more usage" as 20 times more over the whole period, not only inside a five-hour window. Anthropic pointed to its help pages, which explain that the multiplier applies per session. The judge noted that this explanation sat "two hyperlinks away from the primary sales pages", and buyers didn't have to see it before paying.

What the Claude Max 20x lawsuit claims

The plaintiffs, Karl Kahn and Solomon Smith, say the 20x and 5x figures applied only to the rolling five-hour limit, while a separate weekly cap cut the real total. By their count, for one Claude model, the $200 plan gave about 6 times Pro's weekly usage and the $100 plan about 3.5 times. The complaint says "six to eight times".

No court has confirmed those numbers, and Anthropic did not comment on the ruling.

Max 20x is now Ultra

On October 30, 2026, Anthropic renamed its plans. According to the Claude Help Center, "The Max 20x plan is now called the Ultra plan." Existing subscribers moved over automatically with no price change.

Ultra costs $200 a month. Anthropic now describes it as "10 times the Pro plan's usage every week" with "no five-hour limit, for verified accounts". The $100 plan is simply called Max, with "five times the Pro plan's usage every five hours and every week".

So the official promise for the top plan changed from 20x to 10x, stated per week this time. You can compare the plans on the Claude pricing page.
